1. Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the use of shipping services provided by Service d’expédition Klickship Inc.(“Klickship,” “we,” “our,” or “us”) through our self-service kiosk locationsand website (klickship.ca). By using any Klickship service, you (“Customer,”“you,” or “your”) agree to be bound by these Terms.

Klickship operates as an authorized DHLExpress shipping center, providing customers with access to international anddomestic shipping services through a network of self-service kiosks locatedacross Canada. Our services include obtaining shipping quotes, creatingshipping labels, processing payments, and facilitating package drop-off at ourkiosk locations.

Please read these Terms carefully beforeusing our services. If you do not agree with any part of these Terms, youshould not use our services.

2. Eligibility

You must be at least 18 years of age to useKlickship’s services. By using our kiosks or website, you represent and confirmthat you are 18 years of age or older. Klickship reserves the right to refuseservice to anyone who does not meet this requirement.

3. Services Provided

Klickship provides the following services through its kiosk locations and website:

•  Shipping quotes for international and domestic shipments via DHL Express
•  Shipping label creation and printing
•  Payment processing for shipping services
•  Package drop-off at authorized kiosklocations
•  Shipment tracking updates and notificationsvia email
•  Digital receipts Klickship acts as an intermediary between thecustomer and DHL Express.

The actual transportation, delivery, and handling of shipments is performed by DHL Express and is subject to DHL’s own terms andconditions of carriage, which are available at dhl.com. By using Klickship’s services, you acknowledge and agree to DHL’s terms and conditions in additionto these Terms.

4. Pricing and Payment

Shipping rates displayed at the kiosk are based on the package dimensions, weight, origin, destination, and service type selected. The quoted price is the price you will be charged at the time of payment.

All payments are processed securely by Moneris Solutions, a PCI DSS Level 1 certified payment processor. Klickship does not store, process, or have access to your credit card number, CVV, or anysensitive payment card data. Payment card information is entered directly intothe Moneris terminal at the kiosk and is handled entirely by Moneris.

All prices are quoted and charged in Canadian dollars (CAD) unless otherwise indicated. Applicable taxes are included in the quoted price

5. Refunds and Cancellations

Klickship offers refunds under the following conditions:

•  Full refunds are available for international shipments throuhg DHL Express if the shipment has not yet left Canada.
•  Once a shipment has left Canada, refunds are subject to DHL Express’s terms and conditions and may not be available.
•  To request a refund, contact Klickship at service@klickship.com or 1-855-974-9742. 

Klickship reserves the right to assess refund requests on a case-by-case basis. Processing times for approved refunds may vary depending on your payment provider.

6. Prohibited and Restricted Items

You are solely responsible for ensuring that the contents of your shipment comply with all applicable laws, regulations, andcarrier restrictions. You must not ship any items that are prohibited orrestricted by DHL Express, Canadian export regulations, or the import regulations of the destination country.

Prohibited items include, but are not limitedto:
•  Illegal drugs and narcotics
•  Weapons, firearms, ammunition, and explosives
•  Hazardous materials and dangerous goods(unless properly declared and authorized)
•  Counterfeit goods and items that infringe onintellectual property rights
•  Live animals
•  Human remains or body parts
•  Currency, negotiable instruments, and precious metals
•  Items prohibited by the destination country’simport regulations 

A full list of prohibited and restricted items is available from DHL Express. Klickship is not responsible for shipments that are seized, returned, or destroyed due to prohibited or restricted contents. You agree to indemnify Klickship against any claims, fines, ordamages arising from the shipment of prohibited items.

7. Liability and Limitations

7.1 Shipping Liability
Klickship facilitates the shipping process but does not physically transport shipments. The transportation, handling, and delivery of all packages is performed by DHL Express.

Accordingly:
•  DHL Express is ultimately responsible for the safe delivery of your shipment.
•  Claims for lost, damaged, or delayed shipments are governed by DHL’s terms and conditions of carriage.
•  Klickship will assist you in filing claims with DHL Express but is not liable for the outcome of such claims. Klickship’s liability is limited to theshipping service fee paid by the customer.

Klickship is not liable for the value of the contents of any shipment.

7.2 Shipment Insurance
DHL Express provides limited liability coverage as part of its standard terms of carriage. If you require additional coverage for high-value items, you are responsible for obtaining your ownshipping insurance or requesting additional coverage at the time of shipment where available. Klickship does not provide insurance coverage for shipment contents unless otherwise mentionned.

7.3 Service Availability
Klickship strives to ensure that its kiosks and services are available during each location’s operating hours. However, Klickship does not guarantee uninterrupted availability and is not liable for any loss or inconvenience caused by service interruptions, system maintenance, technical issues, or circumstances beyond our control.

7.4 Accuracy of Information
You are responsible for ensuring that all information entered at the kiosk, including sender and recipient details,package dimensions, and weight, is accurate and complete. Klickship is notliable for delays, non-delivery, or additional charges resulting from incorrector incomplete information provided by the customer.

8. Store Operator Responsibilities

Klickship kiosks are located within third-party retail locations operated by independent store operators. Store operators are responsible for:

•  Providing a safe and accessible location for the kiosk
•  Accepting and securely storing packages dropped off by customers until carrier pickup
•  Ensuring that only authorized personnel handle customer packages
•  Maintaining the confidentiality of any customer information visible through the store operator portal 

Store operators are independent businesses and are not employees or agents of Klickship. Klickship is not liable for the actions, omissions, or negligence of store operators. Any disputes regarding the handling of packages at a specific location should be reported to Klickship at service@klickship.com.

9. Intellectual Property

All content, software, trademarks, logos, andmaterials associated with Klickship’s kiosks and website are the property ofService d’expédition Klickship Inc. or its licensors. You may not reproduce,distribute, modify, or create derivative works from any Klickship materialswithout prior written consent.

10. Modifications to These Terms

Klickship reserves the right to update or modify these Terms at any time. Changes will be posted on our website and will take effect immediately upon posting. Your continued use of Klickship’s services after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from or related to these Terms or the use of Klickship’s services shall be resolved in the courts of the Province of Quebec.

2. Privacy Policy

14. Personal Information We Collect

When you use our kiosks or website, we may collect the following personal information: 

Information you provide directly:
•  Full name (sender and recipient)
•  Street address and postal code (sender and recipient)
•  Phone number (sender and recipient)
•  Email address (sender)
•  Package details (dimensions, weight, contents description) 

Information collected automatically:
•  IP address
•  Device and browser information
•  Access timestamps
•  Website interaction data (pages visited,clicks, time on page)
•  Kiosk location identifier 

Information we do NOT collect:
•  Credit card numbers, CVVs, or payment card data (handled entirely by Moneris)
•  Social Insurance Numbers (SIN) orgovernment-issued identification numbers
•  Health or medical information

15. Why We Collect Your Information

We collect personal information for the following purposes:
•  Shipping fulfillment to create DHL Express shipping labels and process your shipment
•  Payment processing to associate your payment with your shipment (card data handled by Moneris)
•  Shipment updates to send you email notifications about your shipment status (pickup, in transit, delivered)
•  Receipts to generate and email you a digital receipt after payment
•  Customer experience to enable repeat customer identification and improve our services
•  Business analytics to analyze shipment volumes, service performance, and kiosk operations for internal business decisions
•  Marketing to send you promotional emails about Klickship’s services (you can unsubscribe at any time)
•  Review requests to email you after delivery asking for a review of the kiosk location you used

16. How We Collect Your Information

We collect personal information through the following channels:
•  Kiosk software you enter your shipping details directly into the kiosk touchscreen during the shipping flow
•  Website (klickship.ca) we collect website interaction data through Google Analytics 4 when you visit our website
•  Email interactions we track email opens and clicks when you interact with shipment notifications or marketing emails

17. Consent

By using Klickship’s kiosk or website services, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

For transactional communications (receipts,tracking updates), your consent is implied when you create a shipment and provide your email address, as these communications are necessary to fulfillthe service you requested.

For marketing communications, we rely on implied consent based on your existing business relationship with Klickship. You may withdraw your consent and unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at service@klickship.com.

For website analytics (Google Analytics 4), data is collected when youvisit our website. You can manage your cookie preferences through your browser settings

18. How We Use Your Information

We use your personal information only for the purposes identified in Section 15 of this document. We do not use your personal information for automated decision-making or profiling. We do not sell, rent, or trade your personal information to any third party.

19. Who We Share Your Information With

We share personal information only with the following third-party service providers, and only to the extent necessary for them to perform their specific function: 

DHL Express — receives sender and recipient name, address, phone, email, and package details for the purpose of shipping label creation and shipment fulfillment.

Moneris Solutions — processes all payment card transactions directly. Klickship does not store or have access to your card data. Moneris is PCI DSS Level 1 certified.

SendGrid (Twilio) — receives your email address and shipment details to send you transactional emails including receipts, tracking updates, and review requests.

Klaviyo — receives your email address for the purpose of sending marketing email campaigns.

Google (Analytics & BigQuery) — receives anonymized website interaction data for analytics purposes and aggregated operational data for internal business intelligence. 

Some of these service providers are locatedin the United States. By using our services, you acknowledge that your personal information may be transferred to and processed in the United States, where privacy laws may differ from those in Canada. We take steps to ensure that your information is protected in accordance with applicable Canadian privacy laws regardless of where it is processed.

20. How We Protect Your Information

We implement the following measures toprotect your personal information:

•  All data transmitted between kiosks, our website, and our servers is encrypted using HTTPS/TLS
•  Kiosks connect to store networks via wired ethernet connections (not Wi-Fi)
•  Our server infrastructure is protected with firewall rules, DDoS protection, 24/7 network monitoring, and restricted SSH access
•  Local backup data is stored on encrypted drives (BitLocker)
•  Payment card data never enters Klickship’s systems, all card processing is handled by Moneris
•  Store operators have access only to their own location’s data and can see only the sender name and tracking number. No other PII information is shown to store owners.
•  Administrative access to our systems is restricted to authorized personnel only

21. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law. Our general retention practices are as follows:

•  Shipment records — retained for a period consistent with business and legal requirements (including CRA record keeping obligations)
•  Marketing contact data — retained until you unsubscribe or until 2 years of inactivity, consistent with CASL requirements
•  Website analytics data — retained accordingto Google Analytics 4’s default retention settings
•  Backup archives — retained on a rolling basisand securely deleted when no longer needed 

When personal information is no longer required, we take steps to securely delete or anonymize it.

22. Your Rights

Under PIPEDA and Quebec Law 25, you have the following rights regarding your personal information:

•  Access you may request to know what personal information we hold about you
•  Correction you may request that we correctvany inaccurate or incomplete personal information
•  Withdrawal of consent you may withdraw your consent for certain uses of your information (such as marketing emails) at anytime, subject to legal or contractual restrictions
•  Complaint you have the right to file a complaint with the Office of the Privacy Commissioner of Canada or the Commission d’accès à l’information du Québec if you believe your privacy rights have been violated

23. Breach Notification

In the event of a security breach involving your personal information that creates a real risk of significant harm, Klickship will:

•  Notify the Office of the Privacy Commissionerof Canada as required by PIPEDA
•  Notify the Commission d’accès à l’information du Québec as required by Law 25
•  Notify affected individuals as soon as feasible, describing the nature of the breach, the information involved, and the steps being taken
•  Take immediate steps to contain the breach and mitigate any harm

24. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. Changes will be posted on our website with the updated effective date. We encourage you to review this policy periodically.
